1. Scope
These terms govern all contracts concluded through this online store between us and you as the customer. A consumer is any natural person entering into the transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). Any terms of your own that deviate from these do not apply unless we have expressly agreed to them in text form.
2. How the contract is concluded
The presentation of pieces in the online store is an invitation to order, not a binding offer on our part.
Ordering works like this: you place pieces in the cart, enter your delivery and payment details at checkout, and reach an order summary. There you can review everything and correct any input errors — by changing the fields directly or navigating back — before ordering. By clicking the order button that indicates a payment obligation, you place a binding order for the goods in your cart.
We then confirm receipt of your order by an automatic email (order confirmation). This confirmation does not yet accept your order; the purchase contract comes into being when we accept it — by sending you a shipping confirmation, or by delivering the goods, whichever happens first. If we cannot accept your order — for example because a piece has meanwhile sold out — we will tell you promptly and refund any payment already made without delay.
The contract language is English. We store the contract data (your order details together with the terms valid at the time of ordering) and send you the order details by email; the current version of these terms is always available on this page.
3. Prices and payment
The prices shown at the time of ordering apply. They are final prices in euros. In accordance with § 19 UStG (small business scheme), we do not charge value-added tax, and none is shown.

For deliveries to countries outside the European Union, additional import duties, taxes or customs fees may arise. These are not charged by us and are payable by you to the responsible customs or tax authorities.
You can pay by credit or debit card (Visa, Mastercard, American Express, Maestro, UnionPay), Apple Pay, Google Pay, Shop Pay, PayPal, Klarna, SEPA direct debit, or the local payment methods Bancontact, BLIK, EPS and MobilePay. The methods available to you are shown at checkout and depend on your country and currency.
You may set off claims against ours only where your counterclaim is undisputed or has been finally established by a court; you may exercise a right of retention only for counterclaims arising from the same contract.
4. Delivery
We ship from Germany to the countries available at checkout — within Germany, to the EU, and to selected countries outside the EU.

If you are a consumer, the risk of accidental loss or deterioration of the goods passes to you only when the goods are handed over to you.
5. Right of withdrawal
If you are a consumer, you have a statutory right to withdraw from the contract within 14 days without giving any reason. Our pieces are made in advance and held in stock, so no exception to the withdrawal right applies to them. 6. Retention of title
The goods remain our property until the purchase price has been paid in full.
7. Warranty and the nature of handmade pieces
Your statutory rights in the event of defects apply in full. For consumers, claims for defects in new goods become time-barred two years after delivery.
Please note the nature of the product: every PARGULI piece is made by hand with genuine fired enamel. Ordinary wear from use is not a defect.
We do not give guarantees beyond your statutory rights unless expressly stated otherwise.
8. Liability
We are liable without limitation for damage caused intentionally or by gross negligence on the part of us, our legal representatives or our agents, and for injury to life, body or health. Liability under the Product Liability Act remains unaffected. For the merely negligent breach of an essential contractual obligation — an obligation whose fulfillment makes the proper performance of the contract possible at all and on whose fulfillment you may regularly rely — our liability is limited to the damage foreseeable and typical for this kind of contract. Any further liability is excluded.
9. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection of provisions of that country's law from which no agreement may derogate (Art. 6(2) Rome I Regulation).
10. Consumer dispute resolution
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
